MIND specializes in services related to embedded software. When providing these services, and more generally in our business operations and our contact with applicants, potential customers, clients, partners, and website visitors, both through the website and otherwise, we may process personal data of natural persons (hereinafter referred to as "data subject," "you," or "your").
MIND undertakes to process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), including any current or future national or international law or regulation implementing or replacing the GDPR, such as the Belgian Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter collectively referred to as “Applicable Data Protection Legislation”).

When providing personal data is a legal or contractual requirement, or a requirement to enter into a contract, you are obligated to provide the personal data. In those cases, if you do not provide (certain) personal data, we may not be able to provide our services or otherwise fulfil our contractual relationship with you.
4. Your rights as a data subject
In certain cases, in accordance with and, where applicable, subject to the limitations of Applicable Data Protection Law, the data subject may exercise the following rights:
4.1 Right of access
You have the right to obtain from MIND confirmation as to whether or not personal data concerning you is being processed, and where that is the case, to access your personal data, obtain specific information and request a copy of that personal data.
4.2 Right to rectification
You have the right to have incorrect personal data corrected or incomplete personal data supplemented.
4.3 Right to erasure (“right to be forgotten”)
In certain cases, you have the right to obtain from MIND the deletion of personal data concerning yourself.
4.4 Right to object
You have the right to object to the processing of your personal data if the processing is based on MIND's legitimate interest or on the public interest. We will stop the processing unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.
You may also object to the processing of your personal data for direct marketing purposes, including profiling to the extent that it is related to such direct marketing. In that case, the personal data will no longer be processed for these purposes.
4.5 Right to withdraw consent
You can withdraw your consent to MIND processing your personal data based on your consent at any time. However, withdrawing your consent will not affect the lawfulness of processing based on consent before its withdrawal.
4.6 Right to restriction of processing
In certain cases, you have the right to restrict the processing of your personal data. In such cases, with the exception of storage, your personal data will only be processed with your consent, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Union or a Member State.
4.7 Right to data portability
In certain cases, the data subject has the right to receive the personal data concerning him or her in a structured, commonly used and machine-readable format and/or to transmit those data to another controller.
These rights can be exercised free of charge by sending an email to privacy@mind.be. We undertake to respond to your request within the timeframes prescribed by Applicable Data Protection Law.
4.8 Right to lodge a complaint

5. Disclosure to Third Parties
MIND will refrain from disclosing personal data of data subjects to third parties, except in the following specific cases:
- Personal data may be shared with third parties, such as service providers to whom MIND has outsourced certain processing activities, such as cloud or mailing services. To the extent these third-party service providers act as our processor, they will only process your personal data in accordance with our documented instructions and the data processing agreement concluded with them;
- If and to the extent required by applicable law or to comply with a legal request.
6. International transfer of Personal Data
In principle, your personal data will only be transferred outside the European Economic Area (EEA) if an adequacy decision applies to that country or the recipient. In other cases, when we transfer personal data outside the EEA, we ensure that appropriate safeguards and, if necessary, additional measures are in place to ensure the adequate protection of your personal data. 7. Storage of your Personal Data
In general, MIND does not retain your personal data for longer than is strictly necessary to achieve the purposes for which we received the data. Retention periods vary depending on the type of processing activity and the purpose for which the personal data was collected.
In particular:
- We process personal data for your application only for the time necessary to process it. If the application is rejected, your personal data will be deleted unless you give us permission to retain it for one year. In the event of a positive decision, MIND's employee privacy policy provides more information about retention periods.
- We retain personal data related to our contracts/collaboration for as long as necessary to fulfill our contract, comply with our legal obligations (such as accounting and tax obligations), and resolve disputes or enforce contracts. Therefore, this personal data is retained for the duration of our contractual relationship and for 10 years thereafter.
- The personal data we collect based on your consent will be retained for as long as your consent remains valid and is not withdrawn.

When we make changes to our Privacy Statement, we will always adjust the date and version number of our Privacy Statement's "last updated." Significant changes will also be announced on our homepage.
